What Employers Need to Do Now to Deal with an Overactive and Employee-friendly National Labor Relations Board

Recent Actions by the National Labor Relations Board (“NLRB”) which impose or are intended to impose broad restrictions on non-unionized employers.

  1. How, if at all, does the National Labor Relations Act (“NLRA”) even apply to nonunion employers?
  2. How should employers navigate the onerous restrictions on confidentiality and non-disparagement provisions in separation agreements resulting from the recent McLaren decision? A practical guide to maintaining enforceable provisions in your separation agreements will be extensively discussed.
  3. The increasing overlap between wage/hour actions under the FLSA and concerted activity under the NLRA- how to recognize such overlap and react in a strategic manner.
  4. Will the so-called Weingarten rights of unionized employees be extended to non-unionized employees?
  5. The future of electronic surveillance of employees’ activities under the present NLRB.

This interactive discussion will be led by two experienced labor attorneys, Howard Kurman and Sarah Goodman, both of whom will present practical advice on how to manage effectively given the very pro-union and pro-employee actions of the present NLRB. In addition to their presentation, Howard and Sarah will provide ample opportunity to respond to any questions participants may have regarding these recent and impactful workplace legal developments.

Howard K. Kurman is an employment attorney. Mr. Kurman regularly counsels clients on all aspects of proactive employment/labor issues. Sarah R. Goodman is a member of Offit Kurman’s Labor & Employment practice group. Sarah’s practice focuses on federal and state labor and employment investigations, counseling, and litigation. She routinely advises public and private employers on workplace matters and employment disputes involving Title VII, ADEA, ADA, state/city statutes pertaining to employment regulations, and policy development. Sarah’s work includes litigating wage and hour, discrimination, sexual harassment, retaliation, and breach of contract claims in federal and state court, and before administrative agencies, including the Equal Employment Opportunity Commission.
