As the laws change around the use of medical marijuana and the nation continues to deal with the opioid crisis many questions regarding the use of drugs arise. One such question is, “How do we navigate drug use in the workplace?” Drug use in the workplace can be present in multiple scenarios ranging from prescription use to substance abuse and each scenario must be dealt with differently and specific to each case. In a comprehensive (and complimentary) breakfast workshop, the experienced Labor and Employment attorneys of Offit Kurman will discuss the precarious circumstances and how you can properly mitigate risk to your business and employees in regards to drugs in the workplace and drug testing.

  • Medical marijuana and the rights of both your employee and company
  • The effects of substance abuse on the business

 

Being aware of how drug use can permeate the workplace is crucial and knowing how to navigate that situation delicately is imperative to the success and safety of both your business and employees.

Mr. Fasic has practiced employment and construction law for over 20 years. His practice is primarily management-based, and includes discrimination claims, wage and hour issues, Davis Bacon/Prevailing Wage claims, employment agreements (including restrictive covenant issues and severance agreements), hiring and firing guidance, unemployment claims, and legislative affairs. He appears frequently before various administrative boards and agencies, as well as private dispute resolution forums.  He has experience practicing before all of Delaware’s state and federal trial and appellate courts and has experience with trial and appellate matters in the state and federal courts of New Jersey and Pennsylvania. Mr. Fasic is certified by the Delaware Superior Court as both a Mediator and as an Arbitrator, and can serve in either capacity for labor/employment and construction law disputes.

Ms. Fry has 24 years of litigation and administrative law experience in every Delaware court, the U.S. Court for the District of Delaware, the U.S. Court of Appeals for the Third Circuit, and the United States Supreme Court. She has also represented clients in proceedings before the Delaware and U.S. Department of Labor, the Equal Employment Opportunity Commission, the Merit Employee Relations Board, and other administrative bodies. She counsels executives and companies in employment matters of all types. Her employment practice focuses on discrimination; non-compete defense and enforcement; Department of Labor audits; employment termination; Fair Labor Standards Act issues; creation and review of employee handbooks and policies; employment and severance agreements; executive compensations; and harassment training. She teaches at the Lerner School of Business at the University of Delaware. She speaks frequently on employment topics and has been a repeat guest on WILM’s radio show, “Money and Politics in Delaware.”

Mr. Delcollo practices in the areas of employment law, commercial law, construction litigation, government regulations, professional licensing, and provides clients advice regarding the right to keep and bear arms. He has represented clients before various administrative boards and Delaware courts. Although his practice focuses on courtroom litigation, Mr. Delcollo regularly consults with clients respecting construction contract formation, contract drafting, contractual interpretation, non-compete contracts, severance agreements, and employment contracts/executive compensation.
