The Employment Review: Guidance for Hospitality Employers on Remaining Union Free

The COVID-19 pandemic has had an especially devastating effect on the hospitality industry. Now, in light of restaurant and hotel closures, and the consequential job losses, we are seeing a surge in employee organizing and union activity. As the industry prepares to reopen and rehire, many employees are seeing this as an opportunity to start anew and make demands of employers, such as healthcare, higher wages and predictive schedules. While all or some of these policy changes may make sense for your business to consider, doing so under the increased pressure of employee social media campaigns and threats to unionize can exponentially complicate the already difficult process of reopening. Join us on September 17, 2020 to learn more about communicating with employees, remaining union-free and reducing your business's exposure. We'll cover the following:

  • Communications: Effectively and permissibly articulating your message during or prior to potential organization; developing policy language that does not infringe upon employees’ rights to discuss terms and conditions of employment; and addressing employees’ social media use.
  • Understand Your Rights: Basic rules and regulations for union organization; employer obligations to allow union access to your property; and proper responses to picketing on or near your property;
  • Maintain Business Objectives: Responding to challenging employment issues in the middle of a union organizing drive; balancing employee demands with maintaining control of your workforce; and policy changes to reduce potential legal exposure.
