Collaborative Design and the Role of the Engineer of Record -- Delegated Design, Design Assist and Informal Involvement
What does it all mean?

Presented By:  Anthony Potter, Principal and Franklin C. Miller, Jr., Attorneys at Offit Kurman, P.A.

The coordination and collaboration of design professional services with contractors has been a focus of the construction industry over the past several decades including the relevant roles and responsibilities.  The concepts of Delegated Design and Design Assist has increased over the years as a result of shifting construction delivery methods and in an attempt to realize the benefits in the process of including constructors in the early design phases.  The aspirational goals include improving constructability, cost, and schedules for Projects.  The paradigm shifts have been accelerated in the construction industry from design-bid build but each delivery method has varying degrees of contractor participation and responsibility for design.  The session will focus on collaborative strategies including informal involvement of a contractor, Design Assist, and Delegated Design including implementation in the Contract Documents and focus on the applicable Building Code Provisions.  We will review and discuss a recent joint white paper published by AIA and AISC as some older white papers published by the Engineer’s Joint Contract Documents Committee and Building Code Provisions to outline best practices.

Learning Objectives:

  • Gain an understanding of the definition of Informal Design Assist, Delegated Design and Design Assist;
  • Discuss the role of the engineer of record in various delivery methods and collaborative models;
  • Focus on the method of collaboration and submission of designs including shop drawings and deferred submissions;
  • Analyze the inherent processes in order to protect the public health, safety and welfare.

Franklin C. Miller, Jr. focuses his practice on the defense and representation of professionals in the design and construction industry. In this capacity, Mr. Miller has been involved in a wide variety of cases, including the defense of architects against serious personal injury/wrongful death claims arising from construction projects, the defense of design professionals from suits brought by property owners alleging design and construction defects and the defense of engineers related to their designs and calculations for integrated building systems such as mechanical, electrical, plumbing and fire suppression.
