Stuart Newman and Tom Pitegoff Featured in the New York Business Law Journal as it Celebrates 25 Years

The New York Business Law Journal, founded by Offit Kurman Business Law and Transactions Principal, Stuart B. Newman, celebrates its 25th anniversary with its latest publication. Founded in 1996, Mr. Newman’s inspiration behind creating “the journal”— as it’s commonly referred to – was to provide timely and practical information to New York State business practitioners. Throughout its 25 years, the journal has been free of charge to all members of the business law section as an added benefit to their membership.

Mr. Newman contributed his own article to the anniversary issue, titled “Before I Sell MY Business.” The article gives practical advice to business owners who might be thinking of selling, including preliminary steps to get the business ready for sale, thereby maximizing the return to the owner and minimizing unexpected hurdles and delays.

Also, in this edition (Vol. 15, No. 1), is an article by Franchise attorney, Thomas Pitegoff, regarding the “terrifying” New York definition of a franchise. For example, brand owners may license selected product lines, create brand extensions, enter new markets or simply enhance their brands through licensing. But few brand owners know that the New York Franchise Sales Act (“NYFSA”), by its terms, regulates licensors who provide no marketing assistance and impose no requirements other than quality control. Mr. Pitegoff argues that this broad definition of a franchise cries out for change in the law.
