Offit Kurman Principal Debbie Petito Quoted in Law360 Mid-Year Labor Coverage

Debbie Petito, head of the Labor & Employment Group with Offit Kurman, was recently quoted in the Law360 article, “5 Labor Battles to Watch in 2024’s 2^nd Half.”  Petito discussed SpaceX’s Lawsuits against the NLRB in the Southern District of Texas, alleging the board is unconstitutional because its members and judges can’t be freely fired by the president, among other claims. Petito told Law360, SapceX’s arguments are then. The board has conducted administrative hearings “forever,” and while these cases aren’t decided by juries, they don’t involve the sorts of damages at issue in court suits.

Petito also discussed the issue of classifying college athletes as employees and whether they are able to organize, telling Law360 she is skeptical of athletes’ case to be treated as employees. While some do get scholarships and generate revenue for the schools, she said the play is voluntary, and the money they make for themselves comes from their personas and not their schools.
