Discovery – Das Tatsachenermittlungsverfahren im US-Recht

Nach der Klageerhebung, aber noch vor dem Hauptverfahren, haben die Parteien im Rahmen  eines Tatsachenermittlungsverfahrens („Discovery“) die Möglichkeit, von der Gegenseite Informationen über relevante Zeugen und Beweismittel einzufordern und auszutauschen. Üblicherweise wird das Gericht hierbei nicht selbst tätig, sondern überwacht lediglich die Sachverhaltsermittlung durch die Anwälte. Während sich ein Kläger in Deutschland nur auf Beweismaterial stützen kann, das sich in seinem Besitz befindet, ermöglicht die die Discovery in den USA auch den Zugriff auf Material bei der gegnerischen Partei. Hierdurch wird die Beweisposition des Klägers enorm gestärkt und gleichzeitig die beklagte Partei einer umfassenden Herausgabeverpflichtung ausgesetzt.

 

1. Sinn und Zweck

Die Discovery soll den Parteien Chancengleichheit geben und eine missbräuchliche Beweisunterdrückung verhindern. Durch eine ausführliche Ermittlung wird den Parteien nicht nur eine optimale Vorbereitung auf den anstehenden Prozess ermöglicht, sondern sie erhalten auch Einblicke in die Stärken und Schwächen der eigenen sowie der gegnerischen Argumente und Fakten.
