Offit Kurman Telebriefs® | New Chair of the EEOC, Overtime Rules & Congressional Developments

On May 8th the Senate confirmed Janet Dhillon as the new chair of the EEOC. Dhillon comes to her new position with a decidedly pro-management background, having been in legal in-house positions at national retailer Burlington, and at US Airways and JC Penney. The EEOC now has a reconstituted quorum and thus we can expect policy directives and litigation prerogatives in the near future emanating from the Commission.

The public comment period has now ended regarding the proposed DOL white collar overtime salary adjustments so at some point in the near future we can expect the Labor Department to publicize its newly constituted exempt salary level of $35,308. Labor groups have severely criticized what they view as an inadequate salary level, while business groups have deemed the proposed new level as “anti-business”. Nevertheless, we expect the proposed level to be implemented in early 2020. Thus, employers should prepare now for the new salary level.

The House of Representatives has been active in proposing a multitude of workplace legislation, most of which has little chance of enactment, given the Republican control of the Senate. For details about the proposed legislation listen in to the Telebrief recording.
