Offit Kurman Telebriefs | Supreme Court Cases & Maryland Legislation

Recently there have been many developments in the Labor/Employment arena, particularly regarding Supreme Court developments and legislation enacted (but not yet approved by Governor Hogan) which impacts Maryland workplaces. The Supreme Court recently agreed to accept for argument the controversial question of whether the Civil Rights Act of 1964 which prohibits, among other things, discrimination on the basis of “sex”, includes sexual orientation and gender identity within such prohibition. A decision on this question will likely not be issued until sometime in 2020- in the heart of the Presidential campaign.

Legislative developments in the Maryland legislature include passage of the controversial new minimum wage statute; expansion of employer obligations for and exposure to liability arising out of workplace harassment; granting employees the right to take organ donation leave; and the imposition of state-wide “ban-the-box” constraints.
