Why Owners, Contractors, and Design Professionals Need a Mass Tort Litigator on Their Team

Virtually every commercial or residential building constructed before 1988 contains toxic chemicals on the land or the interior fixtures.  Generally, these hazards range from the presence of asbestos to lead paint.  Once the hazard is discovered by the owner or tenant, the first priority must be the safety of the employees who work inside the facility or on its surrounding environments.

After the hazard is neutralized, the focus changes from containment to the determination of insurance coverage.  Most insurance policies are complex and contain a myriad of exceptions and exclusions whose interpretation vary from state to state and from country to country.  In a global economy, these problems are incredibly complicated and require experienced litigators from inception.  Every owner, contractor and design professional needs an experienced litigator who has been involved in these disciplines many times.  Don’t wait for the proverbial certified letter to arrive in the mail from opposing counsel to consult an experienced mass tort litigator.

Over the next year, I will post on our construction group monthly blog a detailed summary of each of the above identified hazards and the best practice solution based on my years of experience as a mass tort litigator.
