Last week, a landlord of a commercial property in Blacksburg, VA locked the doors of a tenant-theater chain alleging the theater chain owed $450,000 in back rent. The attorneys for the theater chain responded by filing an emergency petition for an injunction seeking the court to order the immediate reopening of the theater based upon their allegations that the landlord failed to follow the notice requirements provided for in the lease.
Commercial landlords: Be sure to always follow every notice provision in your lease, including terms about where notice must be served and the amount of time notice must be given before you can take any further action.
