Peter E. Sayer, a skilled and seasoned construction and real estate attorney who has worked in the public and private sector, has extensive experience in construction, commercial litigation, distressed real estate, zoning and land use and transactional matters. Peter assists property owners, developers, contractors, engineers, architects and other real estate professionals in resolving complex construction, real property and land use disputes from inception to conclusion through negotiation, litigation and alternate dispute resolution (arbitration and mediation). He also handles property damage and personal injury matters, landlord-tenant proceedings, mechanic’s liens (filing and foreclosure actions), RPAPL § 881 proceedings and judgment enforcement. Peter regularly reviews and prepares contracts between owners and architects, owners and engineers and owners and contractors with a focus on insurance coverage, indemnity, defense obligations, intellectual property rights and limitations on liability. Peter routinely reviews and prepares license agreements between adjoining landowners to ensure the proper protection of buildings during the construction process. He also regularly engages in extensive contract and lease negotiation and drafting, and always works in a collaborative, cost-effective manner with his clients to protect and maximize the value of his clients’ investments in real estate.
Peter consults with and provides transactional and risk management advice to real estate developers, owners, contractors, architects, engineers, lenders and individuals seeking to minimize exposure and engage in sound contracting, insurance and site safety practices.
Peter appears regularly before all state and civil courts in New York State and before various administrative bodies, handling matters in their entirety and counseling clients through the process. His experience involves the preparation of pleadings, extensive motion practice, discovery, hearings, trial and appellate work.
