Kenneth Flickinger is counsel in the firm’s Distressed Real Estate and Commercial Litigation practice group. For nearly two decades, Kenneth has represented a diverse array of both institutional and individual clients in complex commercial litigation cases from pre-litigation through trial, appeals and collection.
With extensive experience and industry knowledge, Kenneth represents the mortgage lending and servicing industries in everything from prosecuting complex foreclosures to defending consumer claims of fraud, unfair and deceptive acts and practices, credit discrimination and alleged statutory violations, including the Real Estate Settlement Procedures Act (RESPA), the Truth-in-Lending Act (TILA), the Fair Credit Reporting Act (FCRA), the Fair Debt Collection Practices Act (FDCPA), the Equal Credit Opportunity Act (ECOA) and the Home Ownership and Equity Protection Act (HOEPA).
Kenneth counsels clients on issues where litigation and compliance intersect, including complaints with the Consumer Financial Protection Bureau and state Attorney General's Offices. He also represents real estate investors in litigation, including contract disputes, specific performance, real estate fraud, constructive trusts, eminent domain, quiet title, premises liability, landlord/tenant litigation, and evictions.
