Offit Kurman Represents Arnold, JP Morgan Chase Bank, and Wells Fargo Bank, NA Defendants in related NC Supreme Court Cases

Offit Kurman Principal Zipporah Edwards represented Defendants Terrance J. Arnold, Nancy E. Arnold, and JP Morgan Chase Bank, N.A. and Wells Fargo Bank, NA in recent cases filed by American Southwest Mortgage Corp. and American Southwest Mortgage Funding Corp. The cases were two of ten related cases filed in North Carolina against lenders and homeowners, which included claims by the Plaintiffs challenging the priority of various lender's deeds of trust and attempting to rescind satisfactions of certain loans which, if allowed, would have left the North Carolina homeowners subject to multiple mortgages on their homes.

Ms. Edwards won on Summary Judgment at the trial level; however, the Plaintiffs appealed the decision to the NC Court of Appeals. The Court of Appeals unanimously upheld the Trial Courts' judgments. Since the Court of Appeals' decision was unanimous, the Plaintiffs petitioned the North Carolina Supreme Court for discretionary review. On Wednesday, May 4th, the NC Supreme Court denied Plaintiffs' Petitions for Discretionary Review. This denial reaffirms the Summary Judgment rulings Ms. Edwards secured in favor of the Arnold and Chase Defendants and Wells Fargo.
